You must be at least 13 years old (or the minimum age of digital consent in your country) to use ArtifyAI. By using the service, you confirm that you meet this requirement.

Your Account

You can sign in using Google. You are responsible for activity under your account and for keeping access to it secure. Please notify us promptly of any unauthorised use.

Credits, Plans and Payments

• Some models are free to use; others consume credits. Credits and paid plans are purchased through our payment provider, Creem.
• Prices and the credit cost of each model are shown in the app and may change over time. Credits may carry an expiry date where stated.
• Refunds, where applicable, are handled in line with applicable law and our payment provider’s process — contact us to request one.

Acceptable Use

You agree not to use ArtifyAI to create, upload or distribute content that:

• is illegal, infringes others’ intellectual property, or violates privacy or publicity rights;
• is sexual content involving minors, or non-consensual intimate or deceptive imagery of real people;
• is hateful, harassing or deceptive, or promotes violence or self-harm;
• attempts to disrupt, reverse-engineer, overload or gain unauthorised access to the service.

Enforcement

We may suspend or terminate accounts that violate these Terms or that put the service or other users at risk.

Your Content and Ownership

You retain the rights to the images you generate and may use them for personal and commercial purposes, subject to these Terms and applicable law.

You are responsible for the prompts and inputs you provide and confirm you have the right to use them. You grant us a limited license to process your inputs and outputs solely to operate the service.

Our Intellectual Property

The ArtifyAI website, branding and software are owned by us and protected by law. These Terms do not grant you any rights to our trademarks or platform beyond using the service as intended.

Third-Party Models and Availability

Images are produced using third-party AI models (for example, via Replicate). Model availability, behaviour and results are not guaranteed and may change. Your use may also be subject to those providers’ terms.

Service Provided “As Is”

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of results, or uninterrupted availability.

Limitation of Liability

To the maximum extent permitted by law, ArtifyAI and its operators will not be liable for any indirect, incidental or consequential damages, or for loss of data, profits or goodwill, arising from your use of the service. Our total liability is limited to the amount you paid us in the three months before the claim.

Indemnification

You agree to indemnify and hold ArtifyAI harmless from any claims arising out of your content, your use of the service, or your violation of these Terms or applicable law.

Termination

You may stop using the service at any time. We may suspend or terminate access if you breach these Terms or to protect the service or other users.

Changes to These Terms

We may update these Terms. We will post the updated version here and revise the “Last updated” date above. Continued use after changes means you accept them.

Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator of ArtifyAI is established, without regard to conflict-of-laws rules.
